Contest Rules

By participating in this contest, entrants agree to abide by the terms and conditions thereof as established by Holbrook Travel.

No purchase is necessary to enter or win. The contest is open to all who enter the contest and who are at least 18 years of age. Employees of Holbrook Travel, their family members, and direct business partners are prohibited from entering. Entrants are subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. Limit one entry per person.

The entry period ends on October 31, 2018 at 11:59 p.m. EST. Entries received after the entry period are void. Holbrook Travel assumes no responsibility for technical or human errors resulting in lost or late entries.

The prize winner will be selected by a random drawing on or about November 2, 2018 and will be notified by email on or before November 15, 2018. If the prize winner doesn’t acknowledge acceptance of the prize within seven (7) days after being notified that he or she is the prize winner, another winner will be chosen at random.

The prize winner will be required to sign and return a statement of disclosure, waiver, and enrollment form as a precondition to award of the prize. If the prize winner fails to sign and return the requested documents to Holbrook Travel, that prize winner may be disqualified, and the prize will be awarded to a different randomly selected prize winner from the remaining valid entries.

The prize includes the following services for 1 person in single or double occupancy: 1 night at the Wyndham Herradura, 3 nights at Selva Verde Lodge, all meals and hotel taxes, two guided hikes at Selva Verde, whitewater rafting or canopy zip line tour, and economy class airfare from Miami International Airport. Accommodations listed in the itinerary are subject to availability and those of similar or better quality may be substituted.

All other expenses not specified above including, but not limited to, additional beverages, gratuities, personal items, souvenirs, baggage handling fees, taxes, currency exchange fees, bottled water, transportation to and from U.S. airport are the sole responsibility of the prize winner.

Any additional fees or penalties incurred as a consequence of any changes made to any travel arrangements after they are booked that are made at the request of prize winner are the sole responsibility of the prize winner. The prize winner is responsible for securing all necessary travel documentation, including any passport or visa, as necessary.

No refund can be made for any feature of the program not used by the participant during operation of the tour.

Subject to availability and valid only for LOW SEASON stays:  May 1-31 or Aug 1 – Dec 15. Prize expires May 31, 2020. No requests for prize substitution or cash redemption will be accepted. Prize is not transferable. Holbrook Travel reserves the right to substitute a prize, or variations of any part of any the prize, of approximately equivalent value. Holbrook Travel makes no warranties or disclaimers concerning the prize. In the event that prize winner chooses to decline any part of the prize with Holbrook Travel’s consent, said portion of the prize will be deemed void and no substitution (monetary or otherwise) will be given. If the prize winner is unavailable to travel during the dates of the trip, the prize will be awarded to an alternate, randomly-selected prize winner from the remaining valid entries.

Entrants agree to release and hold harmless Holbrook Travel and its partners and assigns from and against any claim or cause of action arising out of participation in the contest. Entrants agree that Holbrook Travel is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from participating in this contest.

Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this contest, or any prizes awarded, shall be resolved individually, without resorting to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and in no event attorneys’ fees; and (3) entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages.

All contracts for services provided by Holbrook Travel, Inc., and its affiliates are entered into in the State of Florida and all parties to such contracts submit to the exclusive jurisdiction of the courts of the State of Florida.
